It is the second oldest mechanism  in Latin America (started in 2004). It was enacted as a decree. It was initially located within the Secretariat of Human Rights at the national level (in Brasilia) and by the end of 2016 it was operating in five priority states (PU: Pernambuco, Minas Gerais, Espírito Santo, Ceará and Bahia). A  draft law, under discussion in the legislative Camera since 2009, has not been approved yet. It was last discussed in 2018. This mechanism has been severely criticised by human rights organizations.
